Charlottesville Police Chief RaShall Brackney hopes to use an accusation that the University of Virginia Police Department didn't cooperate in the investigation of a bar fight and stabbing to reexamine the operating agreements between the two agencies, but other officials don't back up her characterization of the case.

Brackney has accused UPD and UVa of withholding evidence and conducting an internal investigation into a Nov. 17 melee at Asado Wing & Taco Co. that involved several people, including two UVa football players and a UVa track athlete.

According to several sources, at least two UVa football players were involved in the scrum at Asado and a track athlete may have been involved, as well. At least one football player was suspended for the team's two games following the fight for violating team rules.

The Daily Progress is withholding all names associated with the case because no one has been charged with a crime.

The melee spilled out onto the street and someone was beaten and stabbed, according to CPD. CPD spokesman Tyler Hawn told the Progress that the victim was treated and then released from the UVa Medical Center.

Brackney called the event a "severe beating, stabbing and possibly attempted homicide," while UVa officials said the injuries and incident appeared much less serious.

If laws are broken, shouldn't the university police department turn over all the information they have to the local police?

Generally with state universities, the university PDs are actual police officers. If it's on UVA campus, they don't have to work with the Charlottesville PD. The CPD chief says they have some sort of agreement to work together, but it sounds like UPD is not being as friendly as she wants them to be.

"We know they were involved and some of that information is protected because it is an ongoing investigation," Brackney said in an interview with The Progress. "But [University Counsel] Tim Heaphy has been very clear that those interviews or those persons involved in those interviews, they're claiming [the Family Educational Rights and Privacy Act] as their exception to releasing any of it."

So the campus police appear to be beholden to some privacy standard that prevents the release of information related to a crime committed in public.

That does seem to be a problem. And also a conflict of interest.

Someone got stabbed, but they don't want to create an issue at their school. This is similar to the problem UVa had a couple of years ago with students being pressured by university employees not to report rapes. Because, you know, reflects badly on the school. This isn't the kind of objective counseling students need.

There's a fine line between victims rights, and schools pressuring students to keep it in the family. It might get crossed when you have someone associated with the university taking the statement of the victim.

I can see a potential for conflict of interest there, and I think that's what the Charlottesville Police Department is concerned about.

Thats what I get for not reading the whole article. I don't see how the university PD can be beholden to an education privacy act when investigating a crime. That is stupid and I can see why CPD is not happy. What happens if a non-student is arrested for the same crime, can they request FERPA? I assume not. And if the interviewed people are able to claim protection under FERPA because they were speaking to university officials, why were the UPD not interviewing them. Fuck UVA

Once the police are aware of a crime, they should be doing the interviews, not the university.

I think I read that the fight took place on the corner, which is (as far as I know, at least) private property within the Charlottesville city limits. I was wondering why university police were called, but I guess that comes right out of the Florida State crisis manual.

Tim Longo, who is currently the interim UVA PD chief, was formerly the Charlottesville PD chief for a while. I'm not saying that plays into this in any way or that it necessarily means anything, but it certainly adds another layer to this story.

Policing in this town is to be discussed on only the thinnest of ice.

I did see something else mentioning that the CPD has a major turnover problem, no one likes the chief, UPD backs up and takes calls for the CPD a lot due to the turnover and understaffing, Albemarle PD is trying to absorb CPD due to understaffing issues and the CPD police chief is doing everything to prevent it, and the CPD is not easy to work with on top of everything. This is from a UVA fan, so take it with a grain of salt, but it could help explain the difficulty of these two PDs working together.

Charlottesville is a city right? In VA cities and counties are independent, the county can't take over primary law enforcement duties of a city.

So who is the UPD police chief's technical boss? I find it hard to believe that it is UVA. Since they are a state organization, it would be the state government correct? Why would UVA even have access to interview in lieu of the police when it's not on campus and does not involve educational rights or issues.
