I do find it curious... @WahooRecruiting isn't affiliated with UVa... There's another account on YouTube, something like OfficialWahooFootball or something like that who comes out with videos trolling VT all the time.

I find it very curious how these guys have very official sounding names and yet somehow aren't affiliated. Something seems a little sketchy here. I know for a fact, if you had a handle like 'HokiesFootball' or 'HokiesRecruiting' for Tech, you'd get a cease and desist very quickly, unless you cleared it with the University, first.

Whats shady is that you're not allowed to talk about recruits by name until they sign the LOI on signing day. And yet, we have these official looking twitter handles calling out recruits by name coming across as if they're representatives of the school, with only a small disclaimer saying they're not affiliated.

I dunno... something just doesn't seem right about that.

The thing is, their Twitter account only has like 100 followers. If you look at the YouTube account you referenced, the only video with more than 100 views is the one that got posted here. The only people paying any attention to these clowns are Hokies who find their efforts humorous. If they want to subtly tie that embarrassment to their University by using words like "official" in their handles, they have my full support.

I'm just sayin... it HAS to be some sort of recruiting violation (and if its not, it coming VERY close to that edge), and UVa is absolutely foolish to not try to reign it in. There's a reason our AD is so protective over the uses of the Hokies name.

Well, I think any fan recruiting on Twitter is technically a violation, because it would be pretty easy to say these fans are boosters according to the NCAA bylaw definition. For what it's worth, there is a VT-centric account that is essentially doing the same thing.

There are two i think... @VTmaroonUNi and the blackout one. the VT maroonuni one is pretty tame to me, he/she does tweet commits though but I don't think he tweets to recruits.. However he/she has mentioned TKP a lot so it might be someone on here?

I REALLY don't want to start a whole thing about this again as it's been covered 2 or 3 times now. But anyone can tweet anyone. NCAA can't limit how people use twitter or anyone's public interaction with anyone else that is not under their bylaws. They can only fine/penalize the school (which has never happened yet) or investigate the recruit and ban them from signing an LOI or penalize them once they've signed (which has never happened without illicit benefits involved). Schools can request twitter to take down the account due to trademark which Twitter can do, but are not unilaterally obliged to do.

HERE are twitter's trademark rules:

How Does Twitter Respond To Reported Trademark Policy Violations?
When we receive reports of trademark policy violations from holders of federal or international trademark registrations, we review the account and may take the following actions:

  • When there is a clear intent to mislead others through the unauthorized use of a trademark, Twitter will suspend the account and notify the account holder.
  • When we determine that an account appears to be confusing users, but is not purposefully passing itself off as the trademarked good or service, we give the account holder an opportunity to clear up any potential confusion. We may also release a username for the trademark holder's active use.
  • We are responsive to reports about confusing or misleading Promoted Tweet and Promoted Trend copy, as well as Promoted Account profile information. For more information, please visit our Trademark Policy for Promoted Products.

What Is not a Trademark Policy Violation?

  • Using another's trademark in a way that has nothing to do with the product or service for which the trademark was granted is not a violation of Twitter's trademark policy.
  • Twitter usernames are provided on a first-come, first-served basis and may not be reserved. For information on why you may not be able to select a certain username, please see our Why Can't I Register Certain Usernames help page.
  • Search and interest keywords advertisers choose are subject to applicable trademark law. Although Twitter may review reports of confusing keywords, we may not disable keywords in every case. For more information about our policies specific to Promoted Products, please see our Promoted Products Policy and our Trademark Policy for Promoted Products.

There's a lot of ambiguity there. Because Twitter is a private corporation they can sell their product, which includes a "first come, first serve" name service. From there so long as you account for the fact that you are not actually affiliated with LOLUVA or VT then they are covered and are not obliged to act if they get a request regarding trademark. And since social media provides a public audience there are lots of ways to claim your account is actually a parody and not an infringement.

I hate to be that guy, but I'm going to respond.

NCAA can't limit how people use twitter or anyone's public interaction with anyone else that is not under their bylaws.

I don't refute anything you said, but it seems there are restrictions in the NCAA bylaws pertaining to "representatives of athletics" (i.e. boosters), so Twitter's trademark policy becomes a moot point.

Bylaw 13.1.2.1 States:

All in-person, on- and off-campus recruiting contacts with a prospective student-athlete or the prospective student athlete's relatives or legal guardians shall be made only by authorized institutional staff members. Such contact, as well as correspondence and telephone calls, by representatives of an institution's athletics interests is prohibited except as otherwise permitted in this section

So, per the NCAA Bylaws, a representative of athletics interests cannot recruit prospective student-athletes.

A representative of athletics interest is defined in Bylaw 13.02.14:

A "representative of the institution's athletics interests" is an individual, independent of agency, corporate entity (e.g. apparel or equipment manufacturer) or other organization who is known (or should have been known) by a member of the institution's executive or athletics administration to:
a) Have participated in or to be a member of an agency or organization promoting the institution's intercollegiate athletics program;
b) Have made financial contributions to the athletics department or to an athletics booster organization of that institution;
c) Be assisting or to have been requested (by the athletics department staff) to assist in the recruitment of prospective student-athletes;
d) Be assisting or to have assisted in providing benefits to enrolled student-athletes or their families; or
e) Have been involved otherwise in promoting the institutions athletics program.

Most fans on Twitter would meet this criteria, if for no other reason than section e is really vague.

This issue was addressed by the Michigan compliance office a few years ago and they interpreted the bylaws the same way:

Boosters are subject to some limitations on their contact with prospective student-athletes. One component of NCAA rules is that only the authorized coaches may recruit on behalf of the institution. This promotes competitive equity by ensuring that every program has the same number of people available to recruit for their program. Boosters are not permitted to recruit prospective student-athletes on behalf of the institution. So it would be a violation of NCAA rules for a booster to contact a prospective student-athlete by Twitter or Facebook to encourage them to attend Michigan.

For the record, as long as the Tweets are positive and respectful and don't reflect negatively on the fan base or school, I don't care if fans Tweet at recruits, and I apologize if I've re-opened this can of worms (Plus, I'm a bagman, so it's not like I'm in a position to judge). It just seems pretty clear to me that this is covered in the NCAA's bylaws, and is technically a recruiting violation, albeit one they can't and will never enforce.

The disagreement that most people have with this policy isn't the NCAA definition of boosters, but rather that the regulation as written is unenforceable and any attempt to enforce it by public institutions runs afoul of the 14th amendment, specifically in section 1 "No State shall make or enforce any law which shall abridge the privileges or immunities of citizens of the United States."

So if the NCAA were to come to a publicly funded school and tell them they need to do something about a fan tweeting to a prospective athlete, the most the school could do is write a strongly worded letter explaining that their actions are a violation and asking them to stop. If they want to get really serious, they could ban the fan from campus events. I would think that if they took the step of banning the fan from campus, it could lead to a lawsuit by the fan against the school, since the school as a government entity is enforcing a policy in an effort to abridge their first amendment rights to freely to speak and associate with others.

You can be that guy, but you're wrong ;) The NCAA is not the government. No matter what bylaw they write they cannot infringe upon Twitter's own corporate governance. So I get what you're saying but none of it matters to Twitter. To them it's just white noise of some other company.

If you want to say that NCAA can classify "anyone" as a booster at their choosing, then this is also incorrect. Again no matter NCAA's bylaws unless I enter into a formal agreement with them, the school or any of their bodies I am not bound by their bylaws. (And buying merchandise or tickets is not a formal contract.) If this were the case then each and everyone one of us would be bound by the bylaws of a hundreds of thousands of corporations, institutions and in NCAA's case non-profits. The NCAA does not get some special dispensation to police the populace. It just isn't so.

So again, the NCAA has zero power to regulate my contacting another person in any way, no matter how much they want to, on twitter. They simply cannot. And the reason you have not seen the NCAA penalize any school, player or recruit simply for someone fan, alumni, student, etc for tweets sent to recruits is because they cannot infringe on that person's use of another corporate body's private property. Again the NCAA is not the government. It has no power to do these things. And if they did penalize one school, player or recruit then they would have to penalize all of them. Which means a) they would have investigations for each tweet to verify if @screwdaNCAA is really a booster or not and b) it opens them up to lawsuits from both Twitter and class action from people using Twitter. Simply will not happen.

Haha I appreciate the response. I agree with this, but to nitpick, I would say that it is still technically a violation of NCAA bylaws, even if the bylaws carry absolutely no weight in court. I could make a 5 mph speed limit sign with a paper plate and a Sharpie and post in my yard. Drivers would blow by it at speeds of up to 25 mph, and I couldn't legally do anything about it, but they would still be in violation of my sign. I do agree with your larger point, though--the NCAA can't legally regulate who fans Tweet. I'm sorry for starting up this debate again. Hopefully someday we can look back on this over a pile of burritos and laugh.

That was one of the best gifts I could have asked for after such a huge win. The T on the field is great but to do it through the campus is legendary.
