WRAL: Student criticizes UNC-CH for handling of rape allegation
A student at the University of North Carolina at Chapel Hill slammed the school Tuesday for how it has handled a rape allegation she made against a football player seven months ago.

"I did everything a rape victim is supposed to do. I reported it. I allowed the rape kit to be taken. I gave a statement. I cooperated with law enforcement and the Title IX office. But six months later, the university has done nothing," she said. "I'm taking this public stand not for me but for the other students on campus who are not protected, despite what the university tells us."

Robinson's case comes three years after five women filed a complaint with the U.S. Education Department's Office of Civil Rights over what they called an atmosphere of sexual violence at UNC. They accused the school of under-reporting sexual assault cases and alleged that administrators had created a hostile environment for students reporting sexual assault.
I don't even know where to begin with this. If there is any truth to these allegations, I don't know how UNC is allowed to field athletic teams anymore. For the record, we're now talking about recruiting and other violations that got Butch Davis fired, academic fraud for the pure benefit of the athletes that got the school itself put on accreditation probation, and now potentially a culture that turns the other cheek when athletes are caught raping fellow students.
At what point is enough enough?
Update: An arrest warrant has been issued for Allen Artis and he has been indefinitely suspended by the school.
It's incredibly interesting this just happens now hours after the story breaks despite the 6 months that have passed since this was first reported to police and the school.

Not only further damaging the reputation of the university, but more importantly psychologically damaging those victims who would have to see the assailant continue to succeed at the university. Disgraceful if true.

So I'll speak to this from the investigator side about JUST the questions. Asking a victim of sexual assault male or female questions about what was happening prior to, during and after an incident, what clothes, jewelry etc were worn, what drinks were drunk, did the victim say no are all VERY important investigatory questions. While question may seem unimportant or pro long they are needed for a complete investigation. The issue becomes when officers and departments go beyond the scope of these questions or make the victim feel like the officers are not treating the crime as real. The questions I don't agree with coming from Officers include sexual history beyond the attacker, a question like that would eventually come from the prosecutors in trial prep but is not important to the investigation unless those encounters happened same time/day as assault.
And telling the suspected rapist, "Don't sweat it, just keep on living your life and playing football." I'm guessing that crosses a line somewhere.
I haven't read enough about the case to comment. I was only speaking to what are common questions asked of a victim during a sexual assault case.
Well to be fair on your bolded part, there is a massive disconnect between what black out drunk actually means and what the public always assumes in these situations and it makes what the officer said actually make some sense.
Blackout drunk does not mean the person is unconscious or incoherent. It just means they can't remember due to their brains not being able to form long term memories. A person can appear to be at a mild level of drunkenness like you would see from your average partygoer.

I disagree. A cease and desist order could be sent out, but the athletic department could credibly say they couldn't read it.
I have been arguing for the death penalty for UNC for a couple of years now. As much as it would hurt the ACC, it really needs to happen.
What this really is is a failure of a university that was already criticized for how it handled sexual assaults continuing to mishandle sexual assaults (they received more coverage in the Hunting Ground than any other school and have had several girls file suit against them recently). This is the by far more pressing issue that will get lost in this just because the accused plays football. There is a lot of change needed in a lot of places with regards to handling sexual assault cases
Not really a Baylor situation unless it comes out that the football team/AD was bullying these kids into keeping quiet and I'd prefer to think no one is that awful
The rape kit was collected and the victim wants to prosecute, then the kit should be submitted to the state crime lab for testing. The PD is really setting themselves up for an investigation on how they handle rape cases if evidence does not get submitted. If you Google "untested rape kits" you will see issues from all over the country. DNA backlogs are large throughout the nation so 6 months without a DNA result is not a shock.
DNA tests especially for rape kits are a difficult subject for police officers. Shows like CSI and SVU make it seem as if a DNA test takes seconds or days at most. It also implies once you have a DNA match you have a suspect. Neither of these are the case, labs are underfunded, understaffed, under built and over worked. People expect DNA and fingerprints to be taken for even minor crimes and in places where the victim has some sway they might actually be sent in. Add that to the overwhelming amount of real tests they need to do with the lack of any real nationwide DNA net and the job is hard. To test every kit in the US from every sexual assault would cost millions upon millions and take years. So depts have had to prioritize sending these kits in. Do they have a viable suspect, does the victim want to press charges.
I'm am one of those overworked people you mention. Well aware of the issues at hand. In today's society the rule is if you have an alledged victim and you have evidence that could identify or link a subject to the victim you test it and let the DAO decide whether to prosecute or not.
All this being said the article only said they "balked" at submitting the kit to the crime lab. With the media attention it is most likely at the lab being expedited. Even after it is tested it could be a long while before there is even a grand jury.
My comments were not at this case. More like a "in general" like with my post about common sexual assault questions for victims. I've found many people jump right to the "rape kit solves it" line. Do you work for NYC lab? NYPD is a leader in sexual assault work.
When I was in NYC I worked for the NYC Medical Examiners Office. They do they DNA testing for the criminal cases in NYC. They have an amazing facility and awesome staff.
Wish VA/OH/SC had even something close to that system. Here in MB area state lab is so backed up local Techinal college/community college is doing some lab work on fingerprints, footprint impressions etc for local police depts.
The lab systems will always be overwhelmed. Some labs volunteered to participate in econ studies to see how they were doing compared to all the labs that were participating. It was data that could be used to lobby for funding for specific changes (i.e. new employees, instrumentation, etc.)
I interned at the VA lab in Roanoke. Love those people. If it wasn't for them I probably would not be in the field.
While working in central VA at a sheriffs dept I sent a sample in a Baggie and a pipe out for testing took 26 weeks for pipe never got results on Baggie.
It's a little better now, only about 3 months or so.

Mostly Northern VA, some goes to Richmond. Looks like they are getting staffing levels improved. A couple years ago, the Northern VA lab was like a ghost town.
Not to mention that the rape kit backlog isn't just there because authorities don't think it matters or completely funding related. Many of the kits aren't tested because of many other reasons. The kits only prove sex occurred. If the accused admits to sex, but the discrepancy is if the sex was consensual it's useless to the case and doesn't get priority. The same happens for those that take plea deals or where the victim doesn't want to go through trial.
You are correct. There are many reasons kits do not get submitted but unfortunately there are situations where kits should have been tested but never were.

Am arrest warrant has been issued for Artis and he's suspended by the school. The incident happened on Valentine's Day, was immediately reported to authorities who sat on it for 6 months. 4 hours after the story goes public the police decide to arrest him.

Really?! This is the most absurd reasoning of why no action has been taken. Haven't we had enough precedents (sadly) to indefinitely suspend players involved with on-campus/off-campus issues until the investigation is completed? Bubba should be fired for that statement as it shows direct mishandling of the situation, and he needs to be held accountable for allowing the player to continue to participate on the team.
Bubba also must not be able to read.
