What a weird past 22ish hours

While I'm glad he is going to play, I really hope this is a 'by the book' kind of situation, not a 'think of the tournament' kind of situation.

edit: to clarify, if this is how the policy normally works, that is fantastic. I find it despicable when other schools bend the rules to get the star athlete a break. I was not trying to imply that was what had happened here.

'By the book' should be a look at the situation and what facts are known, history of conduct, a consideration of innocence until proven guilt, and then making the proper judgement call.

Zero tolerance policies are lazy and do more harm than good. Good for Whit for making (what looks like) the correct judgement.

I would argue that Ty would probably be safe even under a zero tolerance policy. He hasn't been charged with a crime, and the cops found some stuff at his apartment that he shares with a non-family member while he was across the country. He passed a drug test. Zero tolerance of what?

Edit: hasn't been convicted. He was definitely charged.

Besides, this is flimsy at best. He will be 100% cleared of the charge after he returns from Minneapolis.

I'm fine with it. He was in San Jose when the cops smelled burning marijuana outside his apartment. Obviously he wasn't the one smoking. Could be a roommate or a friend in the apartment but he was clearly not there. Regardless of your feelings on the marijuana, it seems likely it wasn't his weed.

It is a misdemeanor charge, which carries no automatic university sanctions, based on weed found in his apartment while he wasn't there, and he passed a drug test when it came up. What else would you have had them do, and what is the point of this post?

I haven't followed the details of the case. If that is what happened, I'm glad it is playing out as it has.

I think it is, but even if it's not - and this may be an unpopular opinion - if Buzz is actually leaving I don't give two shits about doing things by the book. There's no point in punishing/holding people accountable if everyone is leaving and the culture is being rebuilt in a month anyway.

I'm not a fan of extra-judicial policies. Basically, how can VT be more just than just? I can understand certain aspects of risk management like a person being charged with building pipe bombs. For most of these "vice" and behavior control laws, I think the school should wait until the matter is adjudicated in the courts. Can you imagine a student being suspended over drinking a Coke because the town passed a sugary drink law? Sometimes that means a person who is later found guilty of a crime may play through their entire eligibility. Ultimately, it is the job of the justice system to handle these matters and exact punishment.

I also think it is incumbent on players to adhere to the school's policy regardless of how asinine it is, as entering into that relationship is voluntary.

I think it's the idea that you control your property, so if they find stuff in your house or car, there is some control implied.

You're right about the way the law views possession. From Yahoo! Sports:

Montgomery County Commonwealth's Attorney Mary Pettitt told the Associated Press via email that a person can be charged with possession of drugs "even if you are not present with the drugs. You need to have dominion and control over them and do not have to be in actual physical possession."

How can you argue that a dude had "dominion and control" over drugs in his apartment that he's 2500 miles away from and shares with a non-family member?

If that's how the law works, I could potentially be house sitting for Miss Pettitt, and decide that I'm going to blaze up while I'm watering her plants. If the cops show up, then I'd assume she's going to be charged for possession when she gets back from Dollywood.

Yeah but this is the great thing about our legal system is that he's innocent until they can prove beyond a reasonable doubt that it is his not the other way around. Since he's not the only person that lives there and wasn't there at the time he's got more than enough plausible deniability to get out of this.

That's true but it will also cost him thousands of dollars to prove that innocence. I know he could opt for a public defender but that's a first class ticket to a plea.

Which is what will most likely happen. Just funny to see how many people blow this out of proportion or simply don't understand how the law operates. "Busting down the door in a raid!!!!" Marijuana laws are not the problem in this case. It's the local police and Commonwealth Attorney overcharging their way to a softball lob that any defense attorney is going to knock the shit out of.

There are certainly flaws in the execution, as someone who is out of town with lots of other people in their apartment for a party during their absence can surely claim to not have complete control of the space.

Yeah, but in this case you could have just as easily substituted a noise violation for the pot charge.

I'm not saying that there aren't excellent arguments on both sides of the marijuana issue, just that it's irrelevant in this case.

Great statement. Great job by Buzz, Whit, and especially Ty. This was clear cut. He was not there. Had he failed the drug test he would have been suspended. Ty took test, cleared his name.

What sucks is the number of articles that came out last night. There will be the same number that state he is going to play.

Hopefully there will be some journalistic integrity to report the details and get them right. ESPN's article was short on substance and details. It was no more than a nice headline for them. Hopefully they will do right by Ty and correct their story by including all the information and this latest statement from Buzz.

I hope Buzz and Whit are firm and strong in any future statements to fully back Ty. Would be even better if charges were dropped before the game tomorrow night.

The world wide leader in sports should be able to report sports news better than this. By omitting critical details while being the most influential news source for sports, they are doing unjust damage to VT's image. Just a lack of integrity and no effort to be detailed and accurate.

Tacko did get away with 2-3 obvious fouls, which is why I couldn't be too upset when he finally fouled out on a pretty weak contact. Refs gave him like 8 fouls to work with in that game.

To his defense, fouls in college are annoyingly inconsistent and in a lot of cases very phantom. It is my biggest complaint again college hoops.

No replay though....we actually need less of it to be honest, this whole stopping the game to review an incidental contact because someone's holding their nose or mouth, and then assessing a Flagrant foul is straight garbage.
