Just going to add a few comments here - this happened on Oct. 24, so the athletic department (presumably) has known about it for some time.
Furthermore, this is a misdemeanor, which means it is solely up to Whit to decide if it is simply a warning & probation, all the way up to a suspension.

How does portugal handle the cost of Heroin, Cocaine, etc? Who pays for it? The junkies? Or is there no need now, because everyone has kicked it through rehab? My point is that, sure we can "decriminalize" heroin in the US, but I don't see any way to decriminalize the related crime- robberies, drug gang activity, etc. Do their hard core drug users have prescriptions for the stuff? Is there no black market?
This is delving into politics quite a bit at this point. There's gonna be a black market but you take a large portion of that market away. You take the money out of a market and you destroy the market. The idea an hope is that decriminalizing and licensing manufacturers does this. It would obviously still have to be heavily regulated.
You're paying for it now in two ways whether you know it or not....You have a medical problem and a criminal problem. Europe treats it as a medical issue.
There is an abundance of evidence that the criminal related elements of drugs is a direct relation to the black market value of illegal narcotics. A cursory study of prohibition is a good start to understand this. You don't see rampant crime and organized gang related crime from black market alcohol anymore. But it has been lost to many to correlate the time period with what occurs today because of the great job anti-drug propaganda has done on the population for countless generations to make it appear that drugs cause people to do robberies, join gangs...etc when it's actually the opposite. It's also a great money making opportunity for local jurisdictions and the legal apparatus to keep things like this illegal.
I want to add, I come from a LE background having seen the drug war first hand from this side and have never done an illegal drug in my life. I actually believed the way most people do about 20 years ago, but decided to really look into it. And it's mostly alot of baloney.

Because they banned alcohol and got a whole lot of problems from doing so. They banned marijuana and many other substances and didn't get as much kickback from it, so they remain illegal.
When they didn't get a whole lot of troubles from doing so, they were able to make people think that the drugs were evil and keep up the "substance abuse as a moral shortcoming" story they were selling. Again, while alcohol has probably led to so many more deaths, and certainly more health issues because moderation isn't something done in America, it won't be banned again.

I work for a company with a plant in Washington the state and one here in Virginia basically it's legal for those employed in Washington and all that means is they simply don't test for marijuana where as the plant in Virginia still tests for it. Would imagine that's a similar way the schools operate.
On the other hand, it's still a violation of the NFL's CBA to smoke up even if you're a Denver Bronco, Seattle Seahawk, etc. Not sure what the NCAA regulation is, but it wouldn't surprise me if even players in states where it's "legal" aren't allowed to partake, since it's still on the list of controlled substances at the federal level.

Actually, as documented by the NY Times in their Daily podcast and recent paper articles, Juul and other brand name vaping tobacco products have made folks ill and die. I do hear yet to be conducted long-term studies of 20-30 years have shown inhaling Propylene Glycol, Benzoic acid, and Glycerol to be much safer than the usual alternative. The FDA gave a rubber stamp a few years back; the stuff must be safe.

The point of my post was contained in that article. There are cases of people with severe lung issues that reported only using nicotine only vaping products.
Honestly, though, since it doesn't include any actual data on substances found in the blood or anything, you can't fully trust it. People lie to doctors all the time, even about relatively mundane stuff, but especially when it comes to illegal substances, and since the sample size is 19 people, that's only 3 that reported only using non-THC vapes.
All I'm saying is, if you've ever seen one of those anti-vaping ads spreading fear over this "outbreak" and telling people that all vaping is illegal, check and see who produced the ad, and follow the money. I can almost guarantee you that a large portion of the funding came from the tobacco industry, and I'm sure I don't need to tell you that your health isn't exactly their #1 priority.

Can't find any more recent numbers, but as of 2017, 22% of American adults (55,000,000) were "current users" of pot (current use being once or twice within the past year), this is not even counting teens. 35,000,000 were considered regular users (once or twice within the past month at the time of the survey).
Breaking it down to people smoking it doesn't make sense, whether you're smoking, eating, vaping any other methods I'm not hip to, you're using pot.

If you think that weed should be legal then I would suggest Whit look at how he would punish a golfer that is first time offender for underage drinking. The punish should be the same across the department. Time of year shouldn't matter unless you want to over punish while in season because they should lay off the weed until off season.

Lotta players use it as an alternative to pain medication. In many cases it's not the ONLY reason they smoke... but it's a net positive if they are smoking weed rather than maxing out their intake of even OTC NSAIDs, and obviously it's 10000x better than abusing opioids.

I kind of care if they self medicate. If weed is illegal (which it is in va) then there are no regulations/safety in what the players are buying. I would rather them get drugs safely, and be able to talk about the usage with their doctor in case they need other drugs too. I want people to be safe.
I understand your concerns, especially given the vaping stuff that has come to light recently. That said, if you buy bud, you know what it is; it's not like other drugs that can be cut with a powder, or that are created in a lab. If you bake it in to an edible and sit your ass on your couch, you'll be fine. Worst case scenario you eat wayyy to much and you freak out and vomit.
Also, based on a highly informal survey I did with my very non-diverse group of friends, it's pretty common for people to talk openly with their doctors about my marijuana usage. A lot of doctors are treating pot like a vitamin/dietary supplement/herbal remedy, saying "It unproven, but some people report decreased joint pain/anxiety/whatever from occasionally using marijuana. You could try it and see if it helps."
Anyways, back to the crux of the issue here - I find it maddening that someone can get in legal trouble for this. If there's intent to distribute, or driving high, I get it, but walking around high or just having it on you shouldn't be a problem.

Those players need to pursue medical marijuana cards coordinated with the department then. Put some accountability and safety around it. If you did that, I would guess that 98% of players don't take it because they are sore.
Your thoughts on weed in general seem pretty clear based on your many replies in this thread, but I already said the majority of them are not ONLY using it as an alternative to pain meds... I'm not pretending all these young players are primarily smoking weed to heroically avoid potential opioid abuse... but it does act as a way to avoid using too many of any kind of pain med, even taking the max amount of advil you can take a day, every day, for an extended period of time can have some adverse side effects. So I really don't mind them smoking weed as a way to wind down or reduce some aches and pains after practice.
I don't know how viable this is in Virginia, but I'm assuming it's not a viable option to use as pain medication alternative or else a LOT of people, not just players, in VA would be doing this.
Just so we are clear. I would have no problem if marijuana was legal and treated like alcohol...including very aggressive DUI standards. I live in Maryland and I see people smoking blunts in cars regularly- I don't want to be killed by someone baked out no more than I want to be killed by someone hammered drunk. Having said that, telling Fuente to Fuck Off to his face is legal in America technically, and a player would be suspended or more for that. The converse of that is prostitution is illegal, and how bad is it if a player asks a hooker what she charged? does that hurt anyone? That is legal in a few counties in Nevada, but in Va, a player would be charged with a crime for that. It's not legal in Va yet, so Pollard will have to deal with that until it is legal, whatever the punishment will be.
I hear ya on the DUI stuff, if it ever becomes legal I hope they have a strict and effective way to enforce that.
I'm also not saying there shouldn't be any consequences for breaking what is currently a law, but I am saying I hope it's lenient given the degree of the accusation, AND that I disagree with the current laws. I personally think an easy first step is to just decriminalize it like Atlanta has.

There are schools out there where having weed isn't a crime. There are schools where, if you want to smoke, you can. And don't get me started on the NCAA drug testing for weed, its a dog and pony show just for the looks. The last thing the NCAA actually wants to do here is catch someone and punish them, especially given the current climate surrounding the NCAA itself, and the fact that it is legal in some states.
And just because it may be available and legal in some states doesn't mean you have to partake, you just have the legal option. For some recruits, that is going to be a huge selling point. And for those who don't like it, they don't have to partake, just like any apartment party where alcohol is consumed.

It was known that Oregon was the place to go If you wanted to smoke up when Chip was there. The players used that as a recruiting tool.
Every major conference continues to ban marijuana use for players - even the Pac 12 and Mountain West, so that is a moot point. It's not like Colorado players are allowed to blaze up in the locker room. They are tested and punished if caught.
But they don't have police departments looking for it as a crime.
That's a whole different level of enforcement.

It's not complicated:
1. Weed is illegal. Even if many people, myself included, think it should be legal, it isn't. So if you get caught, deal with it.
2. It's a minor offense, so the punishment should fit the crime. A warning, or sitting out a series is all that is needed - "Hey, Norell, don't do that shit, look at all the ruckus and publicity, this is your one time free pass"

Do the crime pay the time. It does not matter whether people think it should be legal, it currently is not so don't do it or suffer the consequences. That being said Whit needs to be consistent, should be the same punishment a soccer player or water polo player gets even though this is a revenue sport.
He has not been proven in a court of law to have committed a crime.
The soccer team doesn't generally get in trouble for this because the "random (which means you don't know when you will be drug tested, not literally randomly chosen)" drug tests are chosen by the coaches. They know who to test.
My personal opinion, and I would apply this to any player on any team, regardless of the upcoming opponent:
His court date is Dec 12. This is a misdemeanor, so no automatic suspension. He is innocent until proven guilty. Do not impose a punishment until he is proven guilty.
Let the punishment fit the crime.
If guilty, suspend him for the week after the bowl game.

I'm really angry at Pollard and Fuente should be too. He needs to be punished. Fuente should make him run 10 laps around the practice field for this. Or 5 stadium stairs minimum. Or he should have to sit through an extra Notre Dame film session. If Fuente is angry enough, make him sit the first series of the next game. Set the example to the rest of the team that if they are caught with marijuana they will have to run extra at practice too. And harass them a bit about being dumb enough to get caught doing it. Teach them the concept of common Sense in a state where the police still care about it.
The tone of this comment matches with your statement of being "really angry", but then you say 10 laps around practice field and I laughed. If you're really angry and don't Pollard to do it again, I would the think the punishment would need to be mroe than 10 laps. What is the probability on any given week that a player in possession of pot gets caught? Probably pretty small. So any player that smokes would say, "hmm...I don't want to run 10 laps, but I probably won't get caught and if I do, it is just 10 laps, so..."
I don't know what Fuente should do, but if he wants to make a zero tolerance type of statement, then the punishment will certainly be more than 10 laps.

Well that's because my comment is more satire than anything else. It's sort of a South Park style commentary. Blending a few different nuanced items together and leaving a bit up to interpretation. It's more a statement about how everyone overreacts to this sort of thing, in both directions. But yeah, I think the punishment should match the seriousness of the crime, hence I think Pollard should have to run some laps for it.
