I don't care for the crust on the outside but I agree it's not at all uncommon for cheesecake to have a external crust (not to mention it always has a defined bottom crust, which cake typically does not have). I personally think cheesecake is more like a pie than cake as well.

Cheesecake is a custard baked in a crust. Most civilized people agree that this makes it a pie, somewhat similar to key lime or pumpkin pies. Some pedantically insist that it is more properly called a tart, even if they can't explain the difference between the two. And there are even a few oddballs who insist that cheesecake belongs in a category all its own, but that's only because they derive pleasure from taking contrarian positions on the Internet. But even they agree that, no matter what you call it, cheesecake is most definitely NOT cake.

In the pie a la mode scenario, the ice cream is simply a condiment. Would you say the ketchup is better than a burger? or that (Vinegar based, always vinegar based) bbq sauce is better than pulled pork?

Okay, fair enough. But how do you live without cheeseburgers?? Cheese fries?? Mounds and mounds of cheese on your salad/entree at Olive Garden? Like seriously if the servers arm doesn't fall off after cranking all the cheese on to your plate, you aren't doing life right.

Not all cheeses are made from sour milk, not all cheeses are molded milk. While I agree that the ones made from sour milk (like cottage cheese) are nasty, cheeseburgers are second only to pizza in terms of deliciousness.

in Lafayette, Louisiana a couple weekends back; I walk into Rouse's grocery across the street from the tailgating at Cajun Field and they have these big football-shaped chocolate whoopie pies. first thought: is a whoopie pie a cake or a pie?

And now I am craving pumpkin pancakes with white chocolate chips covered with pralines in a warm caramel sauce. But that's still breakfast (probably brunch because it does take a bit to make), not desert. I agree that pancakes are the best cakes, but the best pies a clearly better than any cake.
