Common sense is a bullshit phrase that sounds nice on the surface.
In general, people make decisions based on past experiences that are in someway unique to them. It is because of this that an action that seems like common sense to Frank may seem incredibly dumb to Leonard and vice versa. At best common sense is a way of saying something is a social norm for a community, but it doesn't mean that it is a social norm for everyone.

Asking a victim of sexual assault male or female questions about what was happening prior to, during and after an incident, what clothes, jewelry etc were worn, what drinks were drunk, did the victim say no are all VERY important investigatory questions. While question may seem unimportant or pro long they are needed for a complete investigation. The issue becomes when officers and departments go beyond the scope of these questions or make the victim feel like the officers are not treating the crime as real. The questions I don't agree with coming from Officers include sexual history beyond the attacker, a question like that would eventually come from the prosecutors in trial prep but is not important to the investigation unless those encounters happened same time/day as assault.

For trangenders to be discriminated against, either the Supreme Ct or Congress must identify them as a class of individuals and that this class is deserving of equal rights. As of yet, there is no legal authority to support that this notion. No authoritative court case or federal passed law has given transgender individual rights. That's not to say they do not exist, but simply their rights have not been legally recognized.
So, if the DOE revoked funds based on Title IX and the Civil Rights act, it would be because the agency interprets those acts to protect rights of transgender individuals. These acts, however, explicitly say no discrimination based on "race, color, religion, sex, or national origin" but not gender identity. Gender identity could also fall under these Acts, but because it would implicit, it's open to interpretation.
Thus, if DOE revoked funds, NC would surely sue the DOE for revoking their funding on an interpretation that's incorrect. Each side would battle for the correct interpretation of the law.
In sum, only Congress or Supreme Ct can explicitly grant equality rights to transgender individuals. Until then, transgender rights are an implicit interpretation that will undoubtedly have opposing views.

Delaney Robinson said at a press conference Tuesday that UNC linebacker Allen Artis sexually assaulted her earlier this year. Robinson claims campus police interrogated her like a suspect in her own assault and "laughed" at her story while interviewing Artis. The assistant district attorney for Orange County, North Carolina, allegedly said "unconsciousness is rape, blackout drunk is not rape," said Denise Branch, the attorney representing Robinson claims.

"I was treated like a suspect," she said. "What was I wearing? What was I drinking? How much did I drink? How much did I eat that day? Did I lead him on? Have I hooked up with him before? My favorite time of the year for catching stuff off the surf or pier is October. Drum season also means light tackle for speckled trout, puppy drum, false albacore, bluefish, spot, croakers, and sea mullet.
Hilliman is a horse, but he's not Hurd or Conner (or that guy BC had a few years ago....Williams?) It seems like we can bottle up Hilliman if our DL plays well. Towles looked like a guy, not a dude. I remember him at Kentucky, he can run a little and throw it a little but nothing to worry about. I would fear Wade running the QB counter package more than Towles (I won't be surprised if BC goes ECU game plan from last year and throws Wade at us). BC's receiving threats looked dreadful against GT. I would guess BC will need a ST's or D score to get to 20 on Saturday.
On O, if we can keep the tempo up and get the ball to the perimeter, we could score. I'm curious to see if McKenzie might be able to provide some between-the-tackles pile moving in the 2nd half. We were up 23-3 in the 4th last year on BC's D and won 26-10. Seems like it could be a similar score although both offenses are better than last year (BC had zero at QB by the time we played them last year, Towles isn't much but he's certainly better than Flutie).
{I thought GT looked turrible in that game, and I had GT as a preseason Coastal contender. I could see Vandy beating them this weekend.}
Tuna fishing on charter boats is excellent that time of year, with the dolphin bite picking up. If there is a southern or east wind, bluefish (gotcha plugs) and sea mullet (shrimp or tiny chunks of mullet) will be good on the northern piers all the way down to Avon. On a southwest wind, if you can fish with beach from Cape Point in Buxton down to Hatteras Inlet, the big red drum should be around. The issue is that A) if you take a 4x4 on the beach you need a permit and B) there are lots of bird closures that start that time of year.
