what rules? i'm not trying to be an ass, i'm genuinely curious because my understanding is that they have always used guidelines, and the closest i could find to rules are here

my understanding is ND is treated like a P5 because they play against and typically beat P5 teams, BYU for that matter has a schedule similar to most P5 teams
